1. Acceptance of Terms

By accessing or using Swypik ("Platform", "Service"), you confirm you've read, understood, and agree to follow these Terms & Conditions and our Privacy Policy available on the site. These terms form a legal agreement between you ("User") and the platform operator. If you disagree with any provision, please don't use the platform. Continued use after updates means you accept those changes. Users under 18 may have restricted access to certain sections, subject to parental or legal guardian consent. Swypik reserves the right to refuse access or suspend accounts that violate these terms without notice, where legally permitted.

2. Platform Use

The platform lets you discover and buy products through video content created by users and sellers. You agree to use the Service only for legal purposes, in line with these terms and applicable laws in Romania and the EU. Prohibited: abusive infrastructure use (mass scraping, DDoS attacks, exploiting vulnerabilities), bypassing security, uploading malware, impersonating others or brands, and payment fraud. Sellers and creators are responsible for product and content compliance with applicable commercial, tax, and consumer protection laws in Romania.

3. User Accounts

Some features require an account. You're responsible for keeping your login details (password, OTP, sessions) confidential and for all activity on your account. You agree to provide accurate, complete, and current information at signup and throughout use. One account per person is allowed, except if you also have a seller or creator account. Swypik may suspend or close accounts that violate these terms, show suspicious activity, or remain inactive for extended periods. You can request account deletion anytime per our Privacy Policy.

4. User-Generated Content

Users (creators, sellers, buyers) can upload videos, images, reviews, and comments. By uploading, you grant Swypik a non-exclusive, worldwide, transferable, royalty-free license to store, reproduce, display, distribute, and adapt that content to operate and promote the platform. You guarantee you own all rights to your content and it doesn't infringe copyright, image rights, or others' rights. Prohibited: illegal, defamatory, obscene content; content promoting violence, discrimination, or child exploitation; or misleading buyer information. Swypik reserves the right to moderate, remove, or delete any content violating these terms without notice.

5. Purchases & Payments

Swypik processes payments through Stripe under Stripe's terms and policies. Displayed prices include VAT where applicable; shipping costs are shown separately before checkout. Under OUG 34/2014 on consumer rights (implementing Directive 2011/83/EU), you can return purchases within 14 days of delivery without reason, except where the law allows exceptions (personalized items, hygiene-sealed products, etc.). Refunds are processed within 14 days of receiving the returned item. Full return, cancellation, and warranty details are in our "Return Policy" section.

6. Copyright

Swypik respects intellectual property rights and responds to infringement notices under applicable law, including Directive (EU) 2019/790 on copyright in the digital single market. If you believe material on the platform infringes your copyright, send a written notice to legal@swypik.com including: (a) identification of the protected work; (b) exact location of the alleged infringing material; (c) your contact details; (d) a statement under penalty of perjury that the information is correct and you own the rights or are authorized to act. We'll review and may remove the content. Repeated infringements may result in account suspension.

7. Limitation of Liability

Swypik provides the platform "as is" and "as available" without express or implied warranties about uninterrupted availability, error-free operation, or fitness for a particular purpose. To the fullest extent permitted by law, Swypik isn't liable for indirect, incidental, special, or consequential damages (including lost profit, data, or business opportunities) from using or inability to use the platform. For products sold by third-party sellers, the seller bears primary responsibility under e-commerce and consumer protection laws. These limits don't apply to fraud, gross negligence, or where law prohibits liability limits.

8. Applicable Law

These Terms & Conditions are governed by Romanian law. Any dispute arising from or related to platform use will be resolved amicably, or otherwise by competent courts in Romania. Consumers can also use the European online dispute resolution platform (ODR) at https://ec.europa.eu/consumers/odr or contact the National Authority for Consumer Protection (ANPC). If any provision is found invalid or unenforceable, the remaining provisions stay fully valid and binding.
